Restrict/Prohibit the Consumption of Beer in Public Parks or Recreational Areas

WHEREAS, Tennessee Code Annotated, Section 5-5-127, authorizes county legislative bodies to prohibit or restrict the consumption of beer in public parks or recreation areas which are not within the corporate boundaries of a municipality; and,

WHEREAS, the county legislative body of ____________________ County deems that it is in the best interest of the county to establish guidelines to [restrict the consumption of beer] -or- [prohibit the consumption of beer] in public parks or recreation areas which are not within the corporate boundaries of a municipality;

NOW, THEREFORE, BE IT RESOLVED by the county legislative body of ___________________ County meeting in __________ session at ____________________, Tennessee, on this the ____ day of ________________, 20__, that:

SECTION 1. The consumption of beer in public parks or recreation areas which are not within the corporate boundaries of a municipality in ___________________ County is hereby prohibited.

SECTION 2. A violation of this Resolution shall upon conviction be a misdemeanor.

SECTION 3. This Resolution shall take effect upon passage, the public welfare requiring it.
