Fee Officials: 30-Day Deadline to File Salary Agreement or Suit

Fee officials—including court clerks, county clerks, trustees, registers, and sheriffs—must complete a letter of agreement or file a salary suit within 30 days of the adoption of the county budget.

If you agree with the amount budgeted for salaries of deputies and assistants, you may enter into a letter of agreement with the county mayor. This letter should be filed with the same court where a salary suit would be filed. (See below).

A copy of the Comptroller’s approved form is available on the CTAS website.

If you disagree with the budgeted amount, you must file a salary suit within 30 days of budget adoption in the appropriate court:

  • Circuit Court: Circuit court clerks and sheriffs (file in criminal court if your county has one)
  • Chancery Court: Clerk and masters, county clerks, registers of deeds, trustees
