The jail, unlike most other county buildings, may be erected outside the limits of the county town but it must be within the boundaries of the county. However,  if two or more counties enter into an interlocal agreement providing for a jail to serve the counties that are parties to the agreement, then a county that is a party to the agreement is not required to have a jail located within the boundaries of the county, but any jail serving more than one county must be located within the boundaries of one of the counties that is a party to the agreement.
