Adopt the Sheriff's Civil Service Law of 1974

WHEREAS, the County Sheriff’s Civil Service Law of 1974, codified as Title 8, Chapter 8, Part 4 of the Tennessee Code Annotated, is an optional general law which may be adopted by any Tennessee county by two-thirds (2/3) vote of the county legislative body; and

WHEREAS, it is desirable to establish a civil service system for the employees of the sheriff’s department of County, Tennessee;

NOW THEREFORE, BE IT RESOLVED by the county legislative body of ________ County, Tennessee, meeting in session at , Tennessee as follows:

SECTION 1. The County Sheriff’s Civil Service Law of 1974, as amended, codified as Title 8, Chapter 8, Part 4 of the Tennessee Code Annotated, is hereby adopted for the sheriff’s department of _____ County.

SECTION 2. A sheriff’s civil service board is hereby created consisting of three (3) members who shall be selected by the county legislative body as follows:

  • (a) One member to serve a term of one (1) year; successors to serve terms of three (3) years.
    (b) One member to serve a term of two (2) years; successors to serve terms of three (3) years.
    (c) One member to serve a term of three(3) years; successors to serve terms of three (3) years.

SECTION 3. Upon the selection of the three (3) members of the sheriff’s civil service board as provided in Section 2 above, the county executive shall designate one of these three (3) members as the chairperson of the sheriff’s civil service board.

SECTION 4. Each member of the civil service board shall receive an annual salary of __________ Dollars ($ ), to be paid monthly from the county general fund.

SECTION 5. The qualifications, duties and authority of members of the sheriff’s civil service board in ____ County shall be according to the County Sheriff’s Civil Service Law of 1974, including any future amendments to this optional general law.

SECTION 6. The sheriff shall appoint from among the sheriff’s employees a personnel officer, who shall be the keeper of the sheriff’s departmental records and also serve as secretary to the civil service board.

SECTION 7. As soon as practicable after the members of the civil service board have been selected, and in accordance with the provisions of the Sheriff’s Civil Service Law of 1974, as amended, the board shall:

(a) adopt rules and regulations for the administration of the civil service system in _______ County, including rules of procedure for investigation and hearings to be conducted by the board;

(b) establish a roster of all employees of the classified service and the office of sheriff showing their position, rank, compensation, and place of residence;

(c) adopt a classification plan and make rules for its administration. The position classification plan may, if desired, create different classes of positions within each position in the classified service. The position classification plan shall show the duties, authorities, responsibilities and character of work required of each position and each class thereof. The board shall determine the requirements of each position and class thereof as to education, experience, capabilities, knowledge and skill. As far as practical, the probable lines of promotion to and from the classes of positions shall be indicated;

(d) formulate competitive tests to determine the qualifications of persons who seek employment in any position, administer such tests, and as a result of such tests, establish employment lists of eligibles for the various positions;

(e) establish records of performance and a system of service ratings to be used to determine promotions, the order of layoffs and reemployment and for other purposes;

(f) make provisions for the maintenance of such records as may be necessary for the proper administration of the County Sheriff’s Civil Service Law of 1974, as amended;

(g) determine all fringe benefits to employees in the classified service; and

(h) do any and all other things as may be required to properly implement the provisions of the County Sheriff’s Civil Service Law of 1974, as amended.

SECTION 8. At all times, the sheriff and the board shall carry out their respective duties with regard to the implementation and administration of the County Sheriff’s Civil Service Law of 1974 in accordance with the provisions of that law as found in T.C.A. § 8-8-401, et seq.

SECTION 9. This resolution shall be effective upon adoption.
