Approve the Compensation of the Delinquent Tax Attorney

WHEREAS, Tennessee Code Annotated, Section 67-5-2404(a)(1), authorizes the county trustee to select a delinquent tax attorney, with the approval of the county executive; and

WHEREAS, the __________ County Trustee has chosen _________________________ as delinquent tax attorney, with the approval of the __________ County Executive; and

WHEREAS, Tennessee Code Annotated, Section 67-5-2404(a)(2)(A), provides that compensation of the delinquent tax attorney be determined in advance through negotiations between the county trustee and the delinquent tax attorney, subject to approval by the county legislative body, but in no event shall such compensation exceed ten percent (10%) of all delinquent land taxes collected; and

WHEREAS, the __________ County Trustee has negotiated compensation of the delinquent tax attorney to be _____ percent of all delinquent land taxes collected;

NOW, THEREFORE, BE IT RESOLVED by the county legislative body of __________ County meeting in __________ session in ____________, Tennessee, on this _____ day of _____________, 20__, that:

SECTION 1. The __________ County Legislative Body hereby approves the delinquent tax attorney's compensation of _____ percent of all delinquent land taxes collected.

SECTION 2. This resolution shall take effect upon adoption, the general welfare requiring it.
